Terms of Use

This website which is accessible at www.seacen.org (Website) is owned and operated by The South East Asian Central Banks Research and Training Centre (SEACEN), a company registered in Malaysia limited by guarantee without share capital under the Companies Act 1965. Users' access to the Website, and use of the contents of the Website and/or any information in whatsoever form derived from the Website shall be conditional upon acceptance of the terms and conditions of use as hereinafter contained.

The term “The SEACEN Centre” or “SEACEN” or ‘us’ or ‘we’ refers to the owner of the Website whose registered office is located at Lorong Universiti A, 59100, Kuala Lumpur, Malaysia with company registration number (672/82 Tempatan 80416). The term ‘you’ or ‘your’ or ‘user’ refers to the user or viewer or any person who establishes or accesses a connection for access to and/or use of the Website. The SEACEN Centre’s name and The SEACEN Centre’s logo are the property of The SEACEN Centre.

The terms and conditions set forth shall apply to the use of the Website by the user. By using the Website (other than to read these terms and conditions for the first time), the user agrees to comply with all the terms and conditions provided hereof.

1. General

The use of the Website is subject to the following terms of use:

  1. The content of the pages of the Website is for your general information and use only. The SEACEN Centre shall have the right at any time to change or discontinue any part of the Website, including but not limited to, the content and hours of availability, without prior notice.

  2. The Website contains materials which are owned by or licensed to us. These materials include, but are not limited to, the design, layout, look and feel, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

  3. All trademarks reproduced in the Website, which are not the property of, or licensed to us, are acknowledged on the Website.

  4. You may not create a link to the Website from another website or document without The SEACEN Centre’s prior written consent.

  5. Your use of the Website and any dispute arising out of such use of the Website is subject to the laws of Malaysia.

2. User's Conduct

  1. The user shall use the Website for lawful purposes only. The user shall not post or transmit through the Website any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, an invasion of privacy, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without The SEACEN Centre’s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a user that, in The SEACEN Centre's absolute view restricts or inhibits any other user from using or enjoying the Website will not be permitted. The user shall not use the Website to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with the Website.

  2. The Website contains material subject to the protection of copyright, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Website are subject to copyright as a collective work under the Malaysian copyright and trade mark laws. The SEACEN Centre owns the copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. The user may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. The user may download material for the user’s personal use only provided that this is not for the purpose of private or commercial gain. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of The SEACEN Centre and the relevant copyright owner. In the event of any permitted copying, redistribution or publication of material subject to copyright, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The user acknowledges that it does not acquire any ownership rights by downloading such material.

  3. The user shall not upload, post or otherwise make available on the Website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the user. The user shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of the Website, the user automatically grants, or warrants that the owner of such material has expressly granted The SEACEN Centre the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. The user also permits any other user to access, view, store or reproduce the material for that user’s personal use. The user hereby grants The SEACEN Centre the right to edit, copy, publish and distribute any material made available on the Website by the user.

  4. The foregoing provisions of this section are for the benefit of The SEACEN Centre, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

3. Changed Terms

The SEACEN Centre shall have the right at any time to delete, change or modify the terms and conditions applicable to the user’s use of the Website, or any part thereof, or to impose new conditions, including but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means of, including but not limited to, posting on the Website, or by electronic or conventional mail, or by any other means by which you may obtain notice thereof. Any use of the Website of the user after the issuance of such notice shall be deemed to constitute acceptance by the user of such changes, modifications, addition or deletions.

4. Links to Other Websites

The Website may contain links to other websites of interest. These links are provided for your convenience to provide further information. They do not signify that we endorse or recommend the website(s). We have no responsibility for the content of the linked website(s). However, once you have used these links to leave the Website, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by these terms and conditions. You should exercise caution and look at the terms and conditions applicable to the website in question.

5. Website Disclaimer

  1. The user expressly agrees that the use of the Website is at the user’s sole risk. Neither The SEACEN Centre, its affiliates nor any of their respective employees, agents, third party nor any of their respective employees, agents, third party content providers or licensors warrant that the Website will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the Website, or as to the accuracy, reliability or content of any information, service, or merchandise provided through the Website.

  2. The Website is provided on an “as is” basis without warranties of any kind, either expressed or implied, including but not limited to, warranties of title or implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness or completeness, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the applicable laws.

  3. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence or other tortuous behaviour, or under any other cause of action. The user specifically acknowledges that The SEACEN Centre is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with the user.

  4. In no event, will The SEACEN Centre, or any person or entity involved in creating, producing or distributing the Website or the Website’s software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the Website. The user hereby acknowledges that the provisions of this section shall apply to all content on the Website.

  5. In addition to the terms set forth above, neither The SEACEN Centre nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within the Website, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. Neither The SEACEN Centre nor the user shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither The SEACEN Centre, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy, or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.

  6. Reference to any specific commercial product, process or service by trade name, trade mark, manufacture or otherwise by The SEACEN Centre or its affiliates does not constitute an endorsement, a recommendation or a favouring by The SEACEN Centre.

6. Indemnity

The user shall indemnify and hold harmless The SEACEN Centre, its affiliates, and their respective directors, officers, employees and agents from and against all actions, proceedings, costs, claims, expenses, demands, liabilities, losses and damages, claims, or expenses, including legal fees, arising out of the use of the Website by the user.  

7. Copyright Notice

This Website and its content are copyright of The SEACEN Centre. All rights reserved. Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:
  1. You may print or download to a local hard disk extracts for your personal and non-commercial use only; and
  2. You may copy the content to individual third parties for their personal use, but only if you acknowledge the Website as the source of the material.

You may not, except with The SEACEN Centre’s express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.  

8. Third Party Content

The SEACEN Centre is a distributor (and not publisher) of content supplied by third parties and users. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, user or any other user of the Website, are those of the respective author(s) or distributor(s) and not of The SEACEN Centre. Neither The SEACEN Centre nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, not its merchantability or fitness for any particular purpose.

In many instances, the content available through the Website represents the opinions and judgements of the respective information provider, user, or other user not under contract with The SEACEN Centre. The SEACEN Centre neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on the Website by anyone other than authorised employee, spokesperson of The SEACEN Centre while acting in their official capacities. Under no circumstances will The SEACEN Centre be liable for any loss or damage caused by a user’s reliance on information obtained through the Website. It is the responsibility of the user to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through the Website. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other content.  

9. Miscellaneous

These terms and conditions and any operating rules for the Website established by The SEACEN Centre constitute the obligations of the user with respect to the use of the Website and shall be construed in accordance with the laws of Malaysia, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
